Nestpick Global Services GmbH (“NESTPICK”) operates the website available under www.nestpick.com (“Website”). The Website is an online platform for medium term rental opportunities and contains rental listings that can be searched and filtered according to users’ preferences. For booking of a rental listing (“Units”) that is displayed on the Website, a user will be redirected to the respective site of a responsible third party. If the Units is displayed as Nestpick Direct (“Partner Network”), the user will complete the booking process on the Website. These Partner Network Terms shall apply to bookings made by a user on the Site for Units managed and operated by a Partner (a “Partner Booking”).
2. Use of the Website
A user of the Website is allowed to use the Website only for non-commercial purposes. A user is not allowed to (i) disassemble, reverse engineer or decompile in any other way any software, application, or hardware contained in or available via the Website except as permitted by law, or (ii) copy, distribute, communicate to the public, sell, rent, lend or otherwise use the content of the Website except as permitted by law (iii) use any automated program or application to scan, copy, index, sort or otherwise exploit the Website content or any part thereof.
3. Making a Partner Network Booking
Once a Unit is booked by a user, they will receive an email confirmation of such Partner Booking (the “Confirmation”). NESTPICK shall coordinate with the user to enter into a lease agreement directly with the Partner Network partner (a “Partner Lease Agreement”). All terms and conditions of a Partner Lease Agreement are between the user and Partner. Any extension to a Partner Booking shall be the responsibility of the user and the Partner directly.
4. Payment of Fees and Rent
Once a Partner Booking is confirmed, the user shall pay all fees and the total rent owed to NESTPICK, which will be passed along to the Partner. Once a Partner Booking is confirmed, the user is not entitled to a refund of the amount paid, except as specifically set forth herein.
The Partner Network provided by NESTPICK is meant solely to connect users and Partners. The fees paid to NESTPICK by the users at the time of a Partner Booking are in consideration of the service provided by NESTPICK. The user understands, accepts, and acknowledges that once the services have been fully rendered (as described above), NESTPICK is entitled to the fees listed in the Partner Network Listing. A user shall not be entitled to a refund of our fees except as specifically stated herein.
5. Cancellation and Refunds
Any early termination policies are outlined in the Partner Listing.
To request a cancellation, the user must email firstname.lastname@example.org.
Once a User completes a Partner reservation on the Site (a “Partner Booking”), it is not cancellable or refundable by NESTPICK, except under the following limited conditions.
In the case where the Partner Booking is made with a start date that is at least 30 days from the time of booking, the Guest can receive a refund excluding any service and convenience fees as well as a penalty of 10% of the total booking value provided that the cancellation is made at least 30 days prior to the move-in time (3:00 PM in the destination’s local time if not specified).
If the Partner Booking is for a start date fewer than 30 days after the Partner Booking is made, NESTPICK will retain a penalty equal to one month's rent and full service and convenience fees.
6. Termination After Move-in
Any early termination policies are outlined in the Partner Listing. To request an early termination, the user must email email@example.com.
If the Users wants to terminate a Partner Booking after move-in with a 30 day written notice, in which case no termination fee applies. NESTPICK will keep the total booking value for the 30 days after the Guest’s notice and refund the remaining amount. For early terminations with less than 30 days notice, the Users will need to pay any remaining booking value in full to the Partner. In any termination after move-in, the guest service fee, any convenience fees, and cleaning and utility charges are non-refundable.
7. Cancellation by Partner
Situations may arise outside our control which cause the Partner to cancel the Partner Booking. In such an event, the user shall be entitled to a full refund of amounts paid to NESTPICK. Users agree to hold us harmless from any and all damages associated with any cancellation of a Partner Booking made by a Partner.
If NESTPICK is unable to collect any amounts users owe, NESTPICK may engage in collection efforts to recover such amounts from you.
NESTPICK will deem any owed amount overdue when: for authorized charges, sixty (60) days have elapsed since NESTPICK’s first attempts to charge your payment method or try to reconcile a disputed charge after the services have been provided.
NESTPICK has the right to raise court judgments against the user or their business so that a court can decide if the user owes money. You hereby explicitly agree that all communications in relation to amounts owed will be made by electronic mail or phone, as provided to NESTPICK by you. Such communications may be made by NESTPICK or anyone on their behalf, including but not limited to a third-party collection agent. Third-party agents typically charge a fee for their service which will be added onto your debt.
NESTPICK might seek legal actions against any unfulfilling party, individual or entity, if applicable, will be personally liable for the amounts.
10. Release from Liability
NESTPICK is not responsible for third party content (such as prices) displayed on the Website. Where the Website offers links to other sites and content provided by third parties, these links are provided for user’s information only. NESTPICK has no control regarding the contents of those sites or resources. Third party terms and conditions may apply to the Website’s listings. NESTPICK is not responsible for any agreements users enter into with any third party regarding a listing on the Website.
For the Partner Network listings, the user acknowledges and understands that: (i) NESTPICK is not, and will not, act as the landlord (property owner or property manager) under any Partner Lease Agreement with respect to any Unit obtained pursuant a Partner Booking; (ii) all maintenance of the Unit is the sole responsibility of the Partner, not us; (iii) we are not responsible for the content of any Partner Listing nor any inaccuracies contained therein; and (iv) any decision to cancel a Partner Booking is solely at the discretion of the Partner. Accordingly, user agrees to release NESTPICK from any liability related to: (a) any damages or injuries relating to the occupancy of a Unit; (b) any allegation or actual violation of any federal or state fair housing laws or regulations; (c) damages caused by a Partner canceling a Partner Booking; and (d) any breach of a Partner Lease Agreement by Partner.
We make no representations and warranties whatsoever with respect to the services provided by a Partner, nor with respect to any Unit booked or listed on the Site, and we hereby disclaim any and all such representations and warranties.
11. Dispute Resolution
European Commission provides an online dispute resolution platform (OS), which can be found at http://ec.europa.eu/consumers/odr/. We are not obligated to participate in a dispute settlement procedure before a consumer sacking office and are willing to do so.
